Agreement to Terms

By accessing or using Regimen (the “Service”), including the website at helloregimen.com, the iOS app, the Android app, and any associated tools or calculators, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

Regimen is operated by Awaken Labs LLC, a New York limited liability company (“Awaken Labs,” “we,” “us,” or “our”).

Eligibility

The Service is intended for individuals 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. We do not knowingly collect information from anyone under 18.

Description of Service

Regimen is a health tracking application that helps users manage personal protocols and related health data. Specific features available within the Service evolve over time and may include tools for logging, scheduling, tracking, calculation, visualization, integration with third-party health platforms (such as Apple Health and Google Health Connect), and educational content.

We reserve the right, at our sole discretion, to add, modify, deprecate, replace, or remove any feature, tool, calculator, content, or capability of the Service at any time, with or without notice. Nothing in these Terms, in our marketing materials, or in any communication from us constitutes a guarantee that any specific feature will continue to exist, behave in a particular way, or remain available.

The Service may be offered through one or more access tiers, including free tiers, paid subscription tiers, trial periods, promotional access, or limited-time offers. The availability, pricing, terms, contents, and continued existence of any tier, trial, or promotional offer may change at any time at our sole discretion, including discontinuing any tier entirely. Current terms applicable to a given tier are displayed at the time of purchase or sign-up.

We reserve the right to modify subscription pricing, including raising prices, at any time. Price changes for new subscriptions take effect immediately upon being displayed. Price changes affecting existing recurring subscriptions will be communicated and applied in accordance with the requirements of the applicable platform (Apple App Store, Google Play Store) or payment processor, and as required by applicable law.

Medical Disclaimer

Regimen is not a substitute for professional medical advice, diagnosis, or treatment. The Service is a tracking and calculation tool. It does not provide medical recommendations, prescribe medications, diagnose conditions, or practice medicine.

Not a HIPAA-covered entity. Regimen is a personal health tracking tool, not a healthcare provider, health plan, or healthcare clearinghouse. Awaken Labs is not a covered entity or business associate under HIPAA, and HIPAA does not apply to data you enter into the Service. Your data is handled in accordance with our Privacy Policy and applicable consumer privacy laws.

• Calculators and tools perform mathematical operations based on the values you enter. They do not account for your medical history, drug interactions, allergies, or individual health factors. Always verify calculations with a qualified healthcare provider before administration.
• Estimates, models, projections, half-life calculations, levels, charts, and any other quantitative output displayed by the Service are approximations based on publicly available data, published research, or values you provide. They are illustrative only, may be incomplete or inaccurate, and do not reflect your individual physiology, metabolism, or response. Do not rely on them for medical decisions.
• Insights, patterns, correlations, suggestions, and any other observations surfaced by the Service are statistical observations identified in the data you have entered. They are not medical recommendations, diagnoses, or advice. They may be incorrect, incomplete, or misleading.
• Content on helloregimen.com and within the App (including blog posts, guides, comparisons, calculator output, and educational materials) is for informational and educational purposes only. It is not medical advice. Some content may discuss substances that are investigational, regulated, off-label, or not approved by the FDA or other regulatory bodies in your jurisdiction.

Always consult a qualified healthcare provider before taking, starting, stopping, adjusting, modifying, or combining any medication, supplement, peptide, hormone, or other substance - whether or not you track it in the Service. Regimen does not provide medical advice, diagnosis, or treatment. You assume full and sole responsibility for any decision to take, not take, change, combine, or otherwise act on any medication, supplement, or substance, and for how you use the information, calculations, insights, and tools provided by the Service.

By using the Service, you acknowledge and agree that:

1. You are solely responsible for your health, medical, and protocol decisions, including any decision about what to take, when, how much, and in what combination
2. Awaken Labs is not responsible for any medication, supplement, or substance you choose to take, obtain, possess, or administer
3. You will verify all information, calculations, dosages, and insights independently with qualified healthcare professionals before acting on them
4. You will not rely on the Service as a sole source of information for any health or medical decision
5. You will consult appropriate healthcare professionals for any medical question and for any decision about what to take or how to take it
6. You use the Service entirely at your own risk
7. Awaken Labs is not liable for any adverse outcomes, side effects, drug interactions, overdoses, underdoses, missed doses, or other consequences resulting from your use of, or reliance on, the Service

User Responsibilities

You agree to:

• Provide accurate information when using the Service
• Maintain the security of your account credentials
• Use the Service in compliance with applicable laws in your jurisdiction
• Not misuse or attempt to circumvent security features
• Verify all calculations and information with a qualified healthcare provider before administration
• Not rely solely on Regimen for medical decisions
• Not use the Service to track substances for anyone other than yourself without their consent
• Not use the Service if you are under 18 years of age

Subscriptions, Billing, and Refunds

The Service may be offered on a subscription basis through one or more channels, including but not limited to:

• Apple App Store for iOS users (governed by Apple’s Standard EULA)
• Google Play Store for Android users (governed by Google Play Terms of Service)
• Direct purchase via our website through third-party payment processors such as Stripe, when offered

Available subscription tiers, pricing, trial or introductory offers (if any), billing periods, and renewal terms are displayed at the time of purchase and may change at our discretion. We make no commitment to offer any particular tier, price, trial, or promotional offer at any time.

To cancel a subscription:

• Android: Google Play Store → Menu → Subscriptions → Regimen → Cancel

To request a refund:

• Website / Stripe-purchased: contact us at support@helloregimen.com (refund eligibility is at our discretion and subject to applicable consumer protection laws)

Subscriptions purchased through Apple or Google automatically renew according to those platforms’ terms unless cancelled before renewal. We are not responsible for charges incurred due to your failure to cancel before renewal. Charges processed by Apple or Google are subject to those platforms’ refund policies, not ours.

Website Tools and Educational Content

We may from time to time provide free web-based tools, calculators, articles, guides, comparisons, and other educational content at helloregimen.com or related domains. All such tools and content:

• Are provided free of charge and on an “as-is” basis
• May be added, modified, or removed at any time at our sole discretion
• Perform any calculations based solely on the values you input and do not account for your individual health factors
• Are for informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment
• Are subject to the Medical Disclaimer above

You should always verify any output from our tools and consult a qualified healthcare provider before making any health or medical decision.

Intellectual Property

Regimen, its design, features, content, brand assets, and all related materials (excluding your personal data) are owned by Awaken Labs LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written permission.

You retain ownership of the data you enter into the Service (protocols, doses, measurements, photos, notes). We do not claim intellectual property rights over your personal health data.

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, and display your data solely for the purpose of providing the Service to you.

Prohibited Uses

You may not use the Service to:

• Violate any law, regulation, or third-party right
• Share, distribute, or facilitate the illegal distribution of controlled substances or prescription medications
• Provide medical advice, diagnosis, or treatment to other persons
• Impersonate any person or misrepresent your affiliation
• Attempt to gain unauthorized access to the Service or other accounts
• Reverse engineer, decompile, or attempt to derive the source code of the Service
• Use automated tools (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or its underlying infrastructure
• Use the Service for any commercial purpose without our prior written consent

We reserve the right to investigate and act against violations, including suspending or terminating your account.

Limitation of Liability

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for any damages arising from your use of, or inability to use, the Service, including but not limited to:

• Software bugs, defects, errors, glitches, or unexpected behavior in the App or website

• Incorrect dose calculations, conversions, or other quantitative output (whether due to user input errors, software bugs, incomplete data, or otherwise)

• Inaccurate or incomplete half-life data, levels, charts, projections, or other estimates

• Insights, patterns, correlations, or suggestions surfaced by the Service that turn out to be misleading, incorrect, or harmful if relied upon

• Health outcomes, adverse events, side effects, drug interactions, or any other medical consequences resulting from your use of or reliance on the Service

• Notifications, reminders, or alerts that fail to be delivered, arrive late, are silenced, blocked, suppressed, or otherwise interrupted for any reason. This includes (without limitation) failures or delays caused by your operating system, device settings, notification permissions, background process restrictions, focus or do-not-disturb modes, battery management features, network or internet connectivity, third-party platforms or services, hardware issues, or any other cause whether or not within our control

• Missed doses, late actions, or any other outcome resulting from any notification, reminder, or alert failure

• Data loss, corruption, or unavailability (though we maintain reasonable backups)

• Temporary or permanent service interruptions, modifications, discontinuations, or downtime

• Loss of profits, revenue, goodwill, data, or other intangibles

• Any third-party services, content, integrations, or platforms (including Apple, Google, Apple Health, Google Health Connect, and payment processors)

You acknowledge that Regimen is a tracking tool, not a medical device, not a healthcare provider, and not a substitute for medical judgment. You use the Service entirely at your own risk.

Our total cumulative liability for any and all claims related to the Service or these Terms shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100). These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Awaken Labs LLC, its officers, directors, employees, agents, and licensors from any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to:

• Your use or misuse of the Service
• Your violation of these Terms or our Privacy Policy
• Your violation of any law, regulation, or third-party right
• Any content you submit or transmit through the Service
• Your medical, health, or treatment decisions
• Any injury or harm resulting from your reliance on information from the Service

Termination

We reserve the right to suspend or terminate your account for violations of these terms, misuse of the Service, or fraudulent activity.

You may delete your account at any time through the app settings. Upon account deletion:

• Your personal data will be permanently deleted within 30 days
• Your subscription (if active) should be cancelled separately through Apple’s App Store, Google Play, or by contacting us if Stripe-purchased, to avoid continued billing
• Data that has already been anonymized for aggregate analytics cannot be individually deleted

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Subject to the dispute resolution provisions below, any legal action arising out of these Terms or the Service must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.

Dispute Resolution; Arbitration; Class Action Waiver

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

Informal resolution: Before filing any claim, you agree to first contact us at support@helloregimen.com and attempt to resolve the dispute informally for at least thirty (30) days.

Binding arbitration: Any dispute or claim arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in New York County, New York, unless otherwise agreed.

Class action waiver: You and Awaken Labs agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

Exceptions: Either party may bring an individual action in small-claims court for any dispute within the jurisdictional limits of that court. We may also seek injunctive or equitable relief in court to protect our intellectual property rights.

Opt-out: You may opt out of this arbitration agreement by sending written notice to support@helloregimen.com within thirty (30) days of first accepting these Terms.

Time Limitation on Claims

Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose, or it is permanently barred.

Apple and Google Platform Terms

If you use the App on iOS, you acknowledge that these Terms are between you and Awaken Labs only, not Apple. Apple is not responsible for the Service or its content. To the extent these Terms conflict with the Apple App Store Terms, the Apple Terms control as between you and Apple, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

If you use the App on Android, similar acknowledgments apply with respect to Google.

Changes to Terms

We may update these terms from time to time to reflect changes in the Service, legal requirements, or business practices. We will update the “Last updated” date at the top of these Terms. Your continued use of Regimen after changes constitutes acceptance of the updated terms. We encourage you to review these terms periodically.

Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Awaken Labs regarding the Service.
